UK CRIMINAL INJURY CLAIM ADVICE

The CICA is a public body that deals with the administration of a compensation scheme for the victims of violent crime throughout mainland UK. The Authority's purpose is to pay damages to the innocent victims of violent crime by providing compensation for mental trauma, physical injury and consequent financial loss. If you have been violently assaulted and suffered a personal injury then even if there is no conviction or if your assailant is unknown you can still make a UK criminal injury claim. The CICA has offices in Glasgow and London and pays out over £200,000,000 in awards to the innocent victims of violent crime every year. There is a separate scheme for Northern Ireland which is administered in Belfast.

The CICA scheme operates a ‘tariff scheme’ to determine the value a UK criminal injury claim. The CICA attributes an individual value to a large number of different injuries and classifies those injuries in bands or tariffs ranging from £1,000 to £250,000. Only the three most serious injuries are considered when assessing the award and the second and third least serious injuries are discounted by a set percentage rather than simply adding the value of all three together to reach an aggregate sum. The maximum total payment for pain and suffering is £250,000 however the CICA also consider claims for wages loss and special expenses in certain circumstances to a further maximum award of £250,000 making the overall maximum possible award of £500,000 in the most serious cases.

If the CICA refuses an award or if the amount of the offer does not reflect the seriousness of the injury then the decision can be appealed to the independent CICA Appeals Panel which will reconsider the application. The Appeals Panel may either uphold the decision of the CICA or substitute a different award to that previously offered. The decision of the Appeals panel is binding on the CICA.
