UK NO WIN NO FEE CRIMINAL INJURY CLAIMS

There are a number of reasons why no win no fee criminal injury compensation claim applications may be refused and these include :-
- failure to report the incident as soon as is reasonably possible
- failure to adequately co-operate with the police or the prosecution of an offence
- the applicants behaviour before during and after the incident that resulted in injury
- the extent of any previous convictions that are not ‘spent’ under the terms of the Rehabilitation of Offenders Act
- lack of severity of the injury which must last for at least 6 weeks and require at least two visits to a medical practitioner
The CICA is a public body that deals with the administration of a compensation scheme throughout mainland UK. The Authority's purpose is to pay damages to the innocent victims of violent crime in Great Britain by providing compensation for mental trauma, physical injury and consequent financial loss. Initial applications for compensation are sometimes refused or an inadequate award is made either of which may lead the applicant to consider an appeal. Appeals are made to the CICA Appeals Panel which is independent of the CICA and reviews the CICA’s decisions. An award by the Appeals Panel is binding on the CICA.
